Can admin decision-makers accept hearsay?
Federal Court: "the information before the Tribunal ... contained some hearsay rather than firsthand information". Can administrative decision-makers accept hearsay?
Indefinite detention “in the meantime”?
Federal Court: The AAT's decision record included: "If his application before the Tribunal is unsuccessful, [the Applicant] would be liable for return to Afghanistan as soon as is reasonably practicable, and in the meantime he would be subject to indefinite detention". As the Applicant was actually not subject to indefinite detention (see s 197C), did the use of the term "indefinite detention" in the decision record mean that the AAT made a decision on an incorrect understanding of the law?
Section 501BA: Minister bound to consider AAT’s reasons?
Federal Court. In exercising his power under s 501BA, are the Tribunal’s reasons for decision always a mandatory consideration? Was it legally unreasonable for the Minister to find that the applicant's risk of recidivism was dependent on whether he would have access to mental health treatment, which in turn depended on whether he would be eligible for NDIS treatment, and yet ignore that a decision under s 501BA would render the applicant a non-permanent resident and thus ineligible for NDIS treatment?
Citizenship appeal: ‘ordinary residence’
Federal Court (Full Court). Did Lee seek to render the subjective intentions of a child’s parents determinative in relation to the ordinary residence of their child? If not, can it nevertheless be said that the focus in relation to the “ordinary residence” of minors is on the intentions of the parents, and that a reason for this surely was that “a child of tender years has no control over where he or she lives”?
cl 14.5 of Direction 79: offsetting of factors allowed?
Federal Court. Was the Tribunal allowed to 'net off’ or offset against one another the various factors that it took into account when considering under cl 14.5 of Direction 79 the extent of impediments that the Applicant may face if removed from Australia?
An exception to the rule against re-litigation?
Federal Court: Applicant: unsuccessfully applied to FCA for judicial review and appealed to FCAFC; did not rely in those proceedings on the grounds relied on in Ibrahim; applied to the HCA for special leave to appeal the FCAFC's decision; made a fresh application to FCA for review of the same administrative decision while the special leave application was pending, but Registrar refused that application as an abuse of process; applied to FCA for order that Registrar accept his fresh application. Should the Anshun estoppel apply against the fresh application?
Proportionality, credibility & legal unreasonableness
Federal Court. Does the concept of proportionality play a role in determining whether an exercise of discretionary power was legally unreasonable? Does the concept of legal unreasonableness apply to individual aspects of the fact-finding of a decision-maker, such as credibility findings? Does the concept of proportionality form part of the assessment of whether a credibility finding has been made in accordance with established principles as to illogicality or irrationality?
Does ‘vulnerability’ involve a comparison between victim and offender?
Federal Court (Full Court). Is the vulnerability of a particular victim because of his or her characteristics such as physical stature relative to the characteristics of the offender a relevant vulnerability for the purposes of paras 8.1.1(1)(b)(ii) and 8.4(2)(c) of Direction 90?
Student visa and materiality
Federal Court. Were the financial capacity criterion and enrolment criterion not entirely independent, with the result that the Tribunal's finding on the latter did not render its error on the former immaterial?
AAT required to speculate on likely length of detention?
Federal Court. In making a decision under s 501CA(4) of the Migration Act 1958 (Cth), was it open to the Tribunal not to speculate about the likely length of the applicant’s immigration detention, even though he had been found to be a refugee? Does NZYQ operate retrospectively?
