Choosing national interests factors subject to reasonableness?

Federal Court. Was the Minister's choice of what factors to take into account for the purposes of assessing the national interest under s 501BA(2)(b)...

Must decision under s 131 be made before visa expiry?

Federal Circuit and Family Court. Does s 131 of the Migration Act 1958 (Cth) imply an obligation that a revocation decision is to be made within a "reasonable time"? If so, can it be said that "the decision-making scheme of Subdivision F gives rise to a powerful implication that the Minister’s obligation to consider and determine a revocation application under s 131 should be discharged within a time which is capable of effecting a restoration of the cancelled rights in both a legal and practical sense"?

Materiality test: is threshold demanding or onerous?

High Court. Can it be said that "each aspect of non-compliance with s 499(2A) [of the Migration Act 1958 (Cth)] was a particular of the one error – a breach by a statutory decision-maker of a condition governing the making of a decision, namely statutory non‑compliance with s 499(2A) of the Migration Act in failing to comply with Direction 90"?

If topics are distressing, witness is unfit?

Federal Court. Does the "fact that a witness may find answering questions about unpleasant topics distressing and evince an unwillingness to answer ... mean that the witness is not in a fit state to give evidence"? Is the Tribunal "entitled to expect that a legal representative for a party will assist it in avoiding error"? Is the Tribunal: "bound to receive evidence of little probative value"; entitled "to be selective about the quality and quantity of material it will consider in any case"?

Can any risk of harm be unacceptable?

Federal Court. The Minister found for the purpose of s 501CA(4) of the Migration Act 1958 (Cth) that the Applicant's offending conduct was so serious that even a low risk of harm was unacceptable. Was it "permissible for the Minister to approach his fact-finding (or satisfaction forming) on the basis that any risk of serious harm to members of the Australian community was unacceptable"?

AAT: adjournment request

Federal Court: Due to s 500(6L), AAT had only 84 days to decide whether to affirm delegate's decision. Applicant asked for adjournment in order to obtain representation. AAT's refusal to adjourn was legally unreasonable. With respect, in answering whether that error was material, did the FCA echo what the writer had written in an article dated 5 Oct 2019: "is it not the case that it is not possible to rule out that the placing of even more weight to [a consideration] could have tipped the scales in favour of revocation?"

Incarceration costs an irrelevant consideration?

Federal Court. In the context of s 501CA(4) of the Migration Act 1958 (Cth), can it be said that, in "taking into account future potential costs associated with the possible incarceration of the applicant while considering the nature of the harm to individuals or the Australian community were the applicant to engage in further criminal or other serious conduct, the Tribunal has had regard to an irrelevant consideration"?

Granular assessment of re-offending risk?

Federal Court. In assessing the risk of a non-citizen re-offending for the purpose s 501(2) of the Migration Act 1958 (Cth), is it unnecessary for a decision-maker to descend to a level of granularity of assessing the risk of specific future criminal conduct, as that would "require the Minister to either develop superhuman prescience or engage in what could only be wild speculation which would ultimately be meaningless"? Is there a "period of limitation in the Act which might prevent the Minister taking action under s 501(2)"?

If delegate cancels, only delegate can revoke?

Federal Court. If a decision to cancel is made by a delegate under s 501(3A), can the Minister personally decide under s 501CA whether to revoke the cancellation?
